    CDF: MPs are using a backdoor to circumvent the Court of Apex

    Representatives were reportedly weighing the clarity and completeness of the August 8 declaration.

    They claimed that the Supreme Court’s decision (written by Chief Justice Martha Koome) only applied to the Constituency Development Fund Act of 2013, not the National Government Constituency Development Fund Act of 2015.

    In 2013, Congress passed the NG-CDF Act, and in 2015, it was revised.

    Supreme Court said the NG-CDF Act was unconstitutional because it violated the separation of powers between the federal government and state and local governments.

    The judges ruled that “in order for a fund to be constitutionally compliant, it must be structured in such a way that it does not involve members of Legislative bodies and Legislative bodies in the discharge of the service delivery mandate, no matter how symbolic that may be.”

    The CDF had already been ruled unconstitutional once, and now it had been done so again. After the High Court ruled that the Act was unconstitutional in 2015, Parliament appealed to the Court of Appeal and successfully overturned that ruling.
