The Anti-corruption court granted the ODPP’s request to drop the graft case involving Sh7.5 billion against Deputy President Rigathi Gachagua.
Due to a lack of evidence, the lawsuit has been dismissed under Section 87.
The defendants were given notice by Magistrate Victor Wakumile that they might be re-arrested in the future for the same or related crimes.
Wakumile sided with the DPP, saying that one cannot prefer charges based on the hope of obtaining evidence.
He criticized the investigating agencies for bringing witnesses to court while they were still gathering information.
The court ordered Gachagua’s Sh12 million bond payment to be returned.
His passport must be returned as well.
Equal treatment will be accorded to the remaining defendants.
