The Nairobi Milimani Commercial Court has ruled in favor of Agriculture Cabinet Secretary Mithika Linturi in a long-standing court battle with Aldai lawmaker Maryanne Kitany. The court has allowed auctioneers to evict Kitany from the Runda home she shared with Linturi and ordered the OCS Runda police station to provide security during the eviction process.
The ruling comes after a series of previous court orders, including a September 27, 2022 order and a January 20, 2023 ruling by Judge Maureen Odero. Kitany had sought an injunction to overturn a decision allowing Linturi to kick her out of the house, claiming she had contributed almost the whole value of the property. However, Linturi argued that there was no marriage between him and Kitany and that the continued appeal was an abuse of the legal system.
Despite Kitany’s pleas for her suit to be heard, Justice Odero dismissed her application and ruled in favor of Linturi. The eviction of Kitany from the Runda house is set to take place with the assistance of the police.
The court battle between the two political figures has been ongoing for several years, with Kitany claiming that she had a right to continue living in the palatial home despite the court’s determination that there was no marriage between her and Linturi. The eviction of Kitany from the Runda house marks the conclusion of a long and drawn-out legal dispute.
